Hi all
I have a quick question
(and its a Kosher one this time
LoL) I tried searching for the answer on the net
but
yeah
Anyways
I know that Alcohol sales stop at 5, I think, on Sunday evenings, right?? Because of City Ordinances?? What for, you say? I am beginning the plans for a Private Party on New Years Eve; with the sale of alcohol on the premises
Do any of you by some chance know where I should start
to receive
IF I even can
a special permit for operation? I am thinking that it will be allowed (when I figure out where to ask); because it is not open to the public
it will be by paid invitations only
and the event will only last for about 4/5 hours; I think special permits are valid for 24 hours, but not sure
Would that even make a difference???
Any ideas?????
Nooskye, Sunday beer sales can go till 10:00pm in Ms., but I'm like Hawk, you are taking alot of liability by selling alcohol to anybody. If they wreck after leaving your party where they bought your alcohol, you are in big trouble. I would let them supply their own.

I see the delimas this is going to present ...
The venue that we are looking into holding our Black Tie Event has all of their permits and licenses posted and are current ... They have agreed to let us have the room for that night ... because it's Sunday and they won't do anything but make money too ... So, should I cut off liquor sales at 10:00 ... and hope they have their own in their cars to continue the party til 1? ... Will the City even allow us to remain open after 10:00 under those circumstances?? One more ? ... If you guys paid for an invitation to a Black Tie Event on New Years Eve ... would you be happy to know that you'd have to BYOB as well? Champagne is included with purchase of the invite ... but all other alcohol sales would be handled by the venue. The alcohol sales are part of the rental agreement for the venue ... they keep it all from the bar ... Would that null and void my liabilities?? Or add to them???
This is the first time I have tried to pull an event like this off ... especially on a Sunday ... Can you tell I am kinda at a loss????

I can't imagine them not granting a special waiver for the times New Years Eve falls on a Sunday...

That would be correct kind sir ... I'm not registered with the ABC ... One headache I don't want until I open my own place :) LoL
BUT ... I do know that our City council has some issues with dance halls operating specifically to code ... to include the sales ... I'm trying to figure out a way around that ... even if it includes that I give them a partial out of the profits for a special permit ... I just don't know where to start ...

I remember a few years back (7?) when New Year's fell on a Sunday and either the city council or some state agency made an exception for Sunday sales of alcohol to bring it more in line with a Saturday night. It would seem prudent to do that again, if NY is on a Sunday this year.
If the venue is supplying the alcohol, they will also have the liability insurance. You should be ok concerning that. The only thing would be the 10:00pm sales since it does fall on Sunday. I do feel like some type of exception will be made though. The problem is that they will probably not tell anybody about the exception until New Years is almost here.

Oh boy ... won't that make any advertising attempts pointless?!?!? :) LoL ... That's about right ... Do you think I should contact the Ward Rep for the area the venue is in??? Noway has given me the number to the ABC ... so I'll call them sometime in the next few days ...
I know it's kinda early ... NY is still like 5 months away??? I just want to make sure all of my ducks are in a row before I go with the final numbers and start paying people out, ya know???

What if it was like a cover charge, where X number of drinks were served per $$$. That way, technically, you wouldn't be selling anything after 10pm, but you could 'give' the customers the drinks they'd already paid for.

No Hawkeye ... I believe I misspoke somehow ... Me? ... Personally? No, I do not hold registration with the ABC or liability insurance (with exception of my equipment) ... I have no need to; I do not own nor operate a bar ... the VENUE, however ... does. It would be like me coming to you and renting your place out for a party ... allowing you to profit from the bar sales, (in lieu of a cash rental fee), which no doubt will greatly out weigh the rental fee ... and my company profitting from the door / ticket prices. That way, we would both profit on a night where it would normally be closed for business. All of it will be completely legal, held in contractual obligations ... Hense the reason I was asking ... So I could be legal for the contractual terms ... but I do not know if 1.) I can or 2.) if I can ... Again ... hense the reason I asked if anyone knew where I should start to ask ... If I can't, then I can't ... no problem ... I'll throw a party on a different occasion ... but if I can .. I would like all of my ducks in a row so I can really start planning instead of just batting around ideas ... I sure as heck don't want to put out any type of money or advertising if it's gonna flop in my lap and I get stuck with, (well deserved if I don't educate myself), hefty fines for not doing something I was suppose to do ... Did I clarify my plans ... or just confuse them more???
EDIT: It's kind of like a Cash Bar at a Wedding Reception ... the Bride's family throws the party ... guests pay if they want to drink ... and they pay the venue directly @ their prices ...

But we would still be serving after the legal cut off time = BIG fines from the City AND the ABC ... don't want that c-belt ... ;) But thanks for the suggestion ... :)

Oh yes C-Belt ... I rarely do gigs with out a contract ... especially events like this ... There's way more to loose than gain if it's not done right ... and legally.
We use my Investor's Attorney, out of a different state ... That way there's little wiggle room through Bias treatment ...

Nooskye, plain and simple, call the Police Department and ATF, explain your plan, and ask what type of permits they require. Then you should be covered.
